Motorcyclist injured in crash due to driver negligence

When an individual is injured in a Massachusetts motorcycle accident, the victim and their friends and family are initially consumed with handling the details surrounding the injuries. Obtaining emergency medical treatment, assessing further medical options and arranging for continuing needs such as physical therapy are all urgent matters that can consume the time and energy of loved ones. In addition, many feel a vast sense of relief that the life of their family member was spared. However, when the negligence of another party leads to a serious motorcycle crash, the victim has the right to pursue legal action against the responsible party.

One manner in which this can occur is a personal injury lawsuit. Achieving a successful outcome in such litigation involves being able to demonstrate that the driver who caused the crash did so through negligence. In some cases, this can be a difficult hurdle to cross. In other instances, negligence is an obvious factor.

One recent Massachusetts incident provides an example. A man was riding his motorcycle in Rehoboth when he was struck by an enclosed vehicle. Police responded to the crash scene, and upon initial investigation a traffic citation was written to the driver of the enclosed vehicle. The citation was for negligent operation of a motor vehicle, as well as for failure to yield the right of way.

The motorcyclist was transported to a local hospital for injuries sustained in the Massachusetts crash. While his injuries were reported as minor, in many instances there is skeletal or muscle damage that is not readily apparent in the hours following a crash. Should this victim decide to pursue a personal injury lawsuit against the driver, the determination made by the responding officer concerning driver negligence could assist him in his claim.
