Catastrophic injuries lead to death, claims in Massachusetts

Driving while under the influence of alcohol or drugs may be among the most blatant acts of negligence displayed by Massachusetts drivers. In far too many cases, drunken driving leads to catastrophic injuries, or even death. The risk of such injuries may be exacerbated when the vehicle opposite that driven by a drunk driver is a motorcycle.

While there is no true compensation for the loss of a loved one, the family of one motorcyclist who was killed may find a bit of solace in knowing that the individual believed to be responsible for their loved one's death is being held accountable. According to reports, the 38-year-old driver who fled the scene of a motorcycle accident and was later found to be intoxicated has been sentenced to a lengthy prison term. The driver could spend up to 18 years in prison after his conviction on charges of vehicular manslaughter, drunken driving and additional charges.

The accident occurred in Aug. 2011, when the driver of a car struck a motorcyclist, a 51-year-old man, killing him. The driver did not attempt to lend aid to the motorcyclist and caused injuries to another party in an additional accident upon leaving the scene. He was found to have a blood alcohol level of more than double the legal limit in Massachusetts.

The family of the man killed in this tragic accident has likely spent a great deal of time working toward healing. As the criminal case ends, the family retains their rights under Massachusetts personal injury laws. The criminal aspects of this case clearly point toward negligence on the part of the driver, which means that the family of the victim may be entitled to monetary damages against him for the loss, pain and suffering and other financial damages permissible under our laws. A victim of catastrophic injuries, or the family of a deceased victim, may find at least financial relief by successfully litigating a wrongful death lawsuit as they look to the future.
