Massachusetts wife files wrongful death after bicycle accident

A truck driver with a checkered driving record may not be facing criminal charges, but reports indicate that he is not off the hook for his involvement in a fatal accident in which he was involved last August. The wife of the Massachusetts man killed in this bicycle accident has filed a wrongful death claim against the truck driver, his employer and truck owners. She is seeking justice against the man and any other negligent parties that she believes are responsible for killing her husband.

According to reports, the accident happened when an 18-wheeler struck a bicyclist, resulting in his death. The truck driver claims that he did not strike the bicyclist, though investigators have discovered that the truck and its driver both have issues worth considering in the case. First, police reportedly found that the truck's horn was not working properly at the time of the accident.

In addition, the truck driver's record indicates that he has a series of traffic violations, including 19 driver's license suspensions in the past three decades. Though a grand jury has decided not to indict the truck driver, the wife of the victim is moving forward with her claims of his negligence. Her suit claims that the accident could have been avoided had the truck driver maintained basic care in operating the truck.

If this Massachusetts wife is successful in her wrongful death claim, she could obtain compensation for her loss that may help her maintain financial security in the face of this tragedy. There is no real compensation for the tragic loss of life that a bicycle accident like this can cause. However, the victim's family may feel a bit of solace in knowing that their claim could hold any negligent parties accountable for their actions.
