Massachusetts family devastated after other's possible negligence

Most accidents involving injuries are tragic and devastating to the victims, their loved ones and the community. In some cases, the events surrounding an accident or its aftermath are even more devastating, such as one recent incident in Massachusetts. In this case, the alleged negligence of one involved party may have contributed to the loss of life.

A teenager recently sustained fatal injuries in a collision between an all-terrain vehicle and a dirt bike. According to reports, the 14-year-old boy was riding on the ATV with his father and younger brother, when vehicle was struck by a dirt bike. The 40-year-old driver of the dirt bike then left the scene of the accident after promising to get help.

The teenager's father attempted to administer CPR, but to no avail. The teenager succumbed to the injuries he sustained. The man who was said to have fled the scene was later discovered getting medical treatment for his own injuries. Authorities then questioned him. So far, reports do not indicate that charges have been filed, though the accident is still under investigation.

It is unknown at this point if the other man ever intended to return or to alert help for the young man he injured. Leaving the scene of the accident and failing to offer assistance could be relevant evidence in any claim of wrongful death if the victim's family decides to sue. To prevail, the family will need to prove negligence to the satisfaction of a civil court in Massachusetts and that the acts proximately caused or contributed to the death of the teenager.
