Massachusetts accident victim may have escaped brain injury

Pedestrians are much more vulnerable in the event of an accident with a vehicle than the drivers or passengers in a car or other enclosed vehicle. Common injuries when a person is struck by a vehicle include broken bones, internal damage and sometimes a brain injury. A woman in Massachusetts that was hit by a car was transported to a nearby hospital with possible life-threatening injuries.

At the time of this report, Sudbury Police had not identified either woman involved. No citations were issued at the scene either, yet the investigation remains underway. Charges may be filled depending on the results. If negligence is found on behalf to the driver, the seriously injured woman may be able to file a personal injury claim seeking compensation for her injuries.

It is always unfortunate when someone gets injured in an accident. This woman was 66 years old and sustained serious injuries that likely complicate her resuming normal activities. Massachusetts laws provide for the right of those injured by the negligence of another to pursue claims for expenses and other damages allowed under state law.

During the investigation, the Massachusetts State Police, along with Sudbury Police, will determine if any criminal charges will be filed. Regardless, the victim can still take the matter to civil court. If she has any lasting medical complications due to a brain injury or impaired movement that requires assistance, the lasting effects can be costly. To prevail in a civil action, she will need to prove that her injuries were suffered due to the negligent conduct of the driver.
