Massachusetts construction accident: worker falls to death

Construction accidents can result in permanent injury or even death, especially for those whose jobs occur in dangerous workplaces. One tragic example of this comes from Massachusetts, where an electrician is now dead following a construction accident in a dangerous workplace. The 63-year-old electrician was in the process of repairing a traffic light when a tractor trailer allegedly struck his bucket truck, sending him plunging to the ground.

Construction accidents like the one in this case underscore just how risky repairing traffic signals can be. According to local law enforcement, the driver of the tractor trailer has received a motor vehicle citation, and the incident is apparently still under investigation.

The electrician killed was described as a 'model employee' who repaired traffic signals over his decades of service in dangerous workplaces across the city. Now, unfortunately, his family will be left without his companionship and financial support. Workers' compensation death benefits will likely provide the family with funds for funeral expenses and lost income. However, because this workplace accident appears to have been caused by a third party, the family may have additional legal remedies available.

Under Massachusetts law, a wrongful death claim may be an option when a fatality is caused by the negligent or intentional actions of another party. While state law generally bans lawsuits by an employee or his estate against an employer when workers' compensation applies, no such ban applies to the claimed negligence of third parties. Therefore, the family may wish to assess its rights under the law to pursue a wrongful death claim against any parties, other than the employer, whose negligence either caused or contributed to the tragic accident.
